Male Trafficking Case Study: United States v. Jason Daniel Gandy, 4:12-cr-503 (S.D. Tex. 2018)
Houston native Jason Gandy was arrested and sentenced to 30 years in prison for four counts of trafficking children for commercial sex. Court records state that Gandy took advantage of the vulnerable victims and manipulated them into performing massages at his “male-only” in-home massage business. Customers would pay for massages that allowed them to fondle the minors and receive sexual gratification through masturbation. In 2012 Gandy attempted to transport victim “Kenny” (pseudonym) to London for the Olympics to perform massages for money. One United Kingdom customs enforcement officer became suspicious of the adult male travelling with an unrelated 15-year-old minor, and their stories did not match under questioning. Gandy and Kenny were denied entry into the UK and returned to the U.S. on separate planes. The UK officials also notified the U.S. Homeland Security Investigations in Houston. Upon arrival in the U.S., authorities seized a laptop carried by Kenny that held incriminating evidence. Gandy was arrested and confined for the next six years during indictment and all the way through sentencing after being found guilty. The investigation uncovered four male victims under the age of 18 that had been coerced into performing massages for sexual gratification as part of Gandy’s massage business, three who remain anonymous and Jose Alfaro. (Zack, 2020). Investigators discovered that Gandy was known throughout the Houston LGBTQ+ community as a businessperson but was unaware of his sexual exploitation of minors. Issues facing public administration officials include identifying victims of human trafficking, correctly classifying human trafficking, overcoming victim/witness hesitancy to come forward, and providing victim medical treatment for mental/physical trauma.

Domestic Minor Sex Trafficking awareness has increased over the last two decades. The main challenges public administration officials face with cases of minor sex trafficking is identifying victims of human trafficking, correctly classifying human trafficking by category, overcoming victim/witness hesitancy to come forward, and providing victim medical treatment and aftercare for mental/physical trauma. At the time of arrest, Gandy had trafficked at least four male victims under the age of 18 for commercial sexual exploitation. The original charge fell under the category of transporting a minor. As the investigation progressed, charges of child pornography were added. After four years of investigations, human trafficking charged were added to the indictment (Zack, 2020).
Human trafficking is an ethical issue at heart. Dehumanizing a human being for personal gain is unethical and goes against sound morals and principled codes of conduct. From a utilitarianism perspective, which focuses on doing the most good for the largest number of people, human trafficking does not bring happiness to the victims, and only a small number of people benefit from the act (comparatively to the rest of the population). Therefore, human trafficking would be unethical. From a deontological perspective, which states that an act is accepted as moral if it is accepted unanimously and considered morally wrong if unanimously condemned. Deontology argues the inappropriateness of human trafficking placing it again in the unethical category (Martinez, 2009).
Key actors in this case include Jason Gandy, the four victims, the UK customs agent, U.S. Homeland Security Investigations (HSI), U.S. District Court Judge Lee Rosenthal, law enforcement, victim specialists, service providers and prosecutors. Judge Rosenthal exhibited sound judicial statesmanship. According to Siegel (2008) the preconditions of law are “expressing social values as social circumstances change and sustaining social solidarity amidst reasonable, irreconcilable disagreement.” Although the case took six years to get to the verdict, sound governance and statesmanship was displayed by the justice system establishing that Gandy was a flight risk and could potentially victimize others should he be let out on bail. By keeping Gandy behind bars throughout the trial, he was unable to influence the victims, or gain access to other minors. This was especially crucial as at least one victim did not realize they were a victim (Zack, 2020).
Fischer’s Biblical covenantal perspective discusses organizational change. This concept applies to the change needed to coordinate efforts between the public administration organizations such as the justice system and social services, and communities that traditionally see less attention and positive involvement. During this case, it was brought up that Gandy was known within the LGBTQ+ community however gaining access to members within the community who might be helpful to the case was difficult. Barriers to organization change such as manipulation and cooptation would need to be overcome and ties to communities made up of some of the most vulnerable citizens would be strengthened (Fischer, 2010).
I agree with the author’s methods, findings, and conclusion. The overall governance portrayed shows a group effort between agencies to work together. Efforts that went into this case as well as others help the fight to eradicate human trafficking, and in particular Domestic Minor Sex Trafficking. Legislation such as the Domestic Minor Sex Trafficking Deterrence and Victims Support Act of 2010 explicitly states “(13) Minor sex trafficking victims are under the age of 18. Because minors do not have the capacity to consent to their own commercial sexual exploitation, minor sex trafficking victims should not be charged as criminal defendants. Instead, minor victims of sex trafficking should have access to treatment and services to help them recover from their sexual exploitation and should also be provided access to appropriate compensation for harm they have suffered.” This powerful statement takes the burden off the victim and places it on the trafficker and the adult(s) committing the acts.
Conclusion
The issue of identifying victims, properly classifying the offenses, investigating charges, prosecuting traffickers, all while meeting the needs of the victim require a substantial amount of coordination by the public administration. This study identified the challenges and what actions were used to overcome them. Shortcoming such as better collaboration and coordination with vulnerable sectors of society were identified. This demonstration of effort shows how good governance helps achieve successful outcomes and reiterates the need to build trust and confidence with all stakeholders. This cannot be done without ethically and morally sound behavior.
Mike Huckabee’s discussion about Christian values and politics cited the book of Matthew where Jesus entered the temple and tossed out all of the buyers and sellers. This was not nice, however it is the effort of fighting for what is right both ethically and morally (A big mistake Christians make in politics, 2017). Public administrators need to be willing to fight for those who are unable to fight for themselves, without sacrificing their ethics and morals. If they are unwilling to do this, then surely evil will prevail.
Biblical Synthesis
The Bible states in the book of I Peter 5:3 “Not domineering over those in your charge but being examples to the flock.” Describes the importance of governance over those under your leadership, whether formal or informal. Setting a solid moral example will encourage others to follow in one’s footsteps (ESV, 2020).
